Reservation Conditions
These Conditions, together with relevant brochure, General Information, web descriptions, Website Terms & Conditions and How to Book, form part of the Client's contract with the Company Stayinsouthernitaly Ltd, whose objectives are displayed in the online brochures of Reservastay.com and Intertourtravel.com
By using this website and completing a reservation, you acknowledge and agree to have read, understood and to be bound by these terms and conditions.
In these conditions, reference to "the Company" and or "Us" shall mean Stayinsouthernitaly Ltd, registered in England and Wales, registered number 04625650 and/or their subsidiaries or associate companies. “The client” shall mean the lead person and everyone named in a booking confirmed online, or by any other booking confirmation method, and anyone else added subsequently to it.
“Accommodation providers” will mean the owner/providers of hotels, apartments, villas and all other accommodation of any description featured on this website. References to “accommodation” means the lodging area assignment including all facilities and services advertised on our website that we have agreed to arrange in connection with the Clients’ confirmed booking.
How to reserve accommodation or other services
Simply search for your chosen destination and dates, select your preferred accommodation provider and proceed to the final booking page or give us a call or send us an email to make your reservation via telephone. To check availability of accommodation in specific dates either use the Search Box or click on the “reserve now” button of the accommodation provider and check their availability online. For the months of July and August fortnightly bookings (minimum) are usually accepted, unless otherwise specified. For the rest of the year a minimum of 3 days bookings are usually accepted, but please check each accommodation for details on minimum rental days. Please ensure you carefully check the dates, prices, the destination and the accommodation provider details before proceeding with your booking. To make your reservation you will be asked to submit personal information, about yourself such as your name, email address, telephone number and address and credit card details. Whenever you provide such personal information we will collate and use such personal information in accordance to our “Privacy Policy” details of which are set out in the Website Terms and Conditions.
Payment & Confirmation
All prices are shown in Euro (€) and all payments are to be made in Euro (€).
To confirm a booking, you must be authorized to make the booking by all persons named on the booking and their parent or guardian for all party members who are under 18 years of age when the booking is made. By completing booking and payment procedure, you are confirming that all persons named on the booking accept the Terms and Conditions and that you will inform the other persons named on the booking of the confirmation details and any other appropriate information. When you accept the Reservation Conditions on the Booking Form you will do so for yourself and on behalf of any other persons named on the booking form, including those substituted or added by agreed amendment. By making the booking you also become responsible for making all payments due under the booking.
Once you have found the preferred accommodation, proceed with the reservation and payment as shown in the “reserve now” section and select the payment method you prefer.
To receive an immediate confirmation of your booking, make your payment of either a deposit or full balance via Paypal account or via Credit Card through our Paypal gateway.
If you choose the "pay later" option, in order for you to receive confirmition of your booking, the deposit must reach our bank account within 7 days from the date of your online reservation, via bank transfer or postal order if living in Italy at the details in our How to Book, Pay and Confirmation page, or your reservation will be cancelled. The remaining balance must reach our bank account no later than 45 days before the holiday start date.
For reservations via telephone, same rules above apply. Payment methods accepted are via debit/credit card through our Paypal gateway, bank transfer or postal order if living in Italy at the details in our How to Book, Pay and Confirmation page.
Please be advised that a booking is not confirmed, nor does a contract exist if the payment is not received, this also applies should you choose “pay later” in the payment section of the "reserve now" area. As soon as we receive your payment, we will send you the confirmed details of your booking via email.
Late payment may be liable to possible administration fees.
If the balance is not received by us, we shall be entitled to cancel the booking, without prejudice to our claim for cancellation charges as stated in this document and to retain the deposit. Please remember that reminders for payment of balance will not be sent.
For last minute bookings, you may have to pay the total balance at the time of reservation, depending on the interval between the online reservation date and the holiday start date.
Age and responsibility
You warrant that you are 18 years of age or over and have legal capacity to use the Company's web brochures and to create a legally binding contract. You warrant that all personal information submitted during accommodation booking is correct and you accept financial responsibility for all transactions made under your name or account. You hereby authorize this web brochure to process all Personal Information about you and the persons named on the booking that has been obtained in connection with your booking. Personal information shall be deemed to include, but not be limited to: any telephone numbers, fax numbers, email addresses, addresses of residences, signatures, ID or passport copies, or any other information belonging to you or your group. The Personal Information that the Company collects shall be obtained, processed and transmitted in compliance with our Privacy Policy, details of which are set out in the Website Terms and Conditions.
Prices and Rates
We endeavour to provide you with highly competitive rates. All prices on the Company's web brochures, and any subsidiaries, affiliates or companies otherwise associated with us, are shown in Euros (€) and may be displayed per person/per night or per duration/per stay. The pricing structure per each accommodation provider is specified in the “prices” section of their details, and are displayed including VAT and all other taxes, unless stated differently on our web brochure or the confirmation email.
From time to time cheaper rates or promotions will become available at our web brochures for a specific stay at an accommodation provider, however, these rates made by accommodation providers may carry special restrictions and conditions, for example in respect of cancellation and refund. To some accommodations may be applied a last minute discount price, usually applied if booked within 7 days of the stay date. Discounts may be applied for fortnightly reservations. Please check the room and rate details thoroughly for any such conditions prior to making your reservation.
Bookings
Accommodations may only be used by the persons named on the booking form: Sub-letting is not permitted. If one of these persons should be prevented from taking up the booking by illness, jury service, redundancy, unavoidable work commitment or the death or serious illness of a close family member, the booking may be transferred to another person provided that: the transfer is requested in writing at least one week in advance, that the request is accompanied by documented proof of the individual and of the reason for the transfer and that the person taking over the agreement agrees to be bound by the booking conditions. Administration fees may be applied per booking, plus all charges of whatever nature levied by the Company’s suppliers. Clients should be aware that some suppliers, particularly airlines, may charge a 100% cancellation fee and the cost of a new ticket.
Extras
We reserve the right to claim an administration charge with the full outstanding balance if you should not settle in full any extra charges before departure, like drinks not included in board meal, telephone calls, heating or air conditioning usage and any other facilities utilized, not included in the reservation.
Special Requests
Special requests should be indicated in the notes box of the online booking form. We will try to arrange special requests to be met, transferring them to the relevant party at whose discretion the service will be provided. Please be advised that a supplement may be required and/or amendment fees may be applicable. We do not guarantee compliance of any special request and do not accept liability for non-provision of the same.
Amendments
In the event of an amendment to a confirmed booking, a fee may be charged to cover administration costs. In the case of a minor amendment (e.g. Cancellation of a pre-booked car) this charge will be applied per booking; in the case of a major amendment (e.g. Change of holiday dates, accommodation or resort) this charge will be applied per person. If you should require a major amendment within 8 weeks of departure, the alteration will be treated as a cancellation of the original holiday (attracting cancellation charges) and will be regarded as a new holiday booking.
Cancellation
Should you wish to cancel your confirmed booking, you must advise us in writing or by email. In the event of cancellation, that shall be effective only when you receive our confirmation email, we reserve the right to retain all or part of the rental paid.
Once the holiday has commenced no refund will be made. If, for whatever reason, you do not turn up at the accommodation on the arrival date stated on your booking, without prior warning to us, (a “no show”), this shall be considered a cancellation and will be affected by the above cancellation regulations. If you decide to alter the arrangements after the commencement of the holiday, i.e. change of accommodation, you will be deemed to be breaking your commitment with us. The Company therefore, accepts no liability for any loss, damage or additional expenses which you or your party incur and no refunds will be made. In the unlikely event that the company may have to cancel your booking for reasons beyond our control, we shall immediately offer you alternative accommodation. Should that not meet with your approval, any rental paid will be refunded in full, there will be no further claim against us and we will have no further liability whatsoever to you. If the Company becomes unable to provide a significant proportion of a holiday after it has commenced, the Company will make suitable alternative arrangements for the Client at no extra charge to the Client or, alternatively, arrange for the Client to be returned to his point of departure and to receive a pro-rata refund for any ground arrangements not received.
Liability
We accept no liability in respect of any loss or damage of any kind caused by wars, threat of war, natural disasters, fire or theft, riots, floods, storms etc., or by any event that constitutes "force majeure".
Breakages
For the Self Catering accommodations no items, fixtures or fittings shall be removed from the accommodation or left outside at any time. We reserve the right to ask for a breakages deposit, payable to us before departure or on arrival. Properties are to be left clean and tidy but normally there will be a final cleaning fee to be paid. We do also ask that our clients respect the properties and treat them with care.
Air Travel
We are able to offer flights through various air travel companies and agents, but they or us do not own or control and do not have any connection with or interest in any of the airlines. The airlines are independent and the Company does not accept any responsibility whatsoever for their acts, default and/or omissions. Please remember that flight times are only estimates and cannot be guaranteed as they are provided by Airlines and are subject to change because of such matters as air traffic control restrictions and weather conditions. In the event of a flight delay we will not be liable for any compensation or loss of holiday enjoyment, unused hotel accommodation and any other losses of the kind.
Insurance and travel arrangements
It is essential to provide for the unexpected, insurance, both before and during your holiday. Insurance caters for most contingencies from the cancellation of your holiday, in circumstances beyond your control (thus insuring deposit for rent, air fares, etc.,) to almost every conceivable problem that can spoil a holiday. The use of a car is strongly recommended for all our accommodations. For your air travel, car hire and insurance please indicate in the notes box in the booking form or contact us, we will give you all our personal assistance. The prices for car hire, air travel, insurance and other services not specified in the Accommodation/Hotel booking are not included in the price unless specified.
Before you travel
The Company is not liable for damages or losses that may result from travel to any particular destination. The British Foreign and Commonwealth Office helps travellers stay safe overseas. Check the FCO website at www.fco.gov.uk/knowbeforeyougo for the latest advice on conditions and general information concerning specific countries.
It is your responsibility to ensure you have the relevant travel and health documents before departure for the country you are visiting, which shall include, but is not limited to, any inoculations that may be required, ID’s and passport. The Company shall not be liable for any expense incurred resulting from your missing, incomplete or incorrect documentation or any non-compliance with requirements.
Local Contacts
Your local contacts are the property owners/carers or hoteliers. They will be concerned on your having a good experience and will be of assistance in case of need or emergency. If a problem rises that cannot be resolved locally, please do not hesitate to contact us, we will be glad to help.
Accommodation Arrival and Departure
Unless differently specified in each Accommodations’ Rental Terms and Conditions, arrival is set to be no earlier than 15.00hrs and no later than 22.30 hrs and to leave no later than 10.00hrs on the morning of departure. If the stay begins on a Saturday and is a weekly booking, your departure day from the accommodation will also be Saturday. During months of July and August fortnightly bookings are usually accepted. During the rest of the year, weekly bookings are usually accepted, although in some cases a number of days different from a weekly base may be accepted. Please check each accommodation for details on minimum rental days.
Accommodation & Accommodation Providers
The client shall behave properly throughout the entire duration of the holiday and, in particular must not perform nor permit any action which may lead to damage of the accommodation and/or accommodation provider, injury to any person, or violation of any contract or of insurance. Self Catering properties are to be left clean and tidy, but normally there is a final cleaning fee to be paid. The Client will be responsible for the cost of repairing or replacing any lost, broken or damaged items, including lost keys.
Complaints
In the event of cause for complaint, you should first seek satisfaction locally through the accommodation and properties. If you are still not satisfied then please contact us immediately by telephone and confirm the details in writing or e-mail whilst you are still in occupation of the property or other accommodation. The Company shall have no liability of any claim that is not made within this period of time, and in any event, the liability shall not exceed the amount paid by the client for the property or other accommodation.
Descriptions
We honestly believe that all statements made in our web brochures are correct. Every reasonable effort has been made to describe the properties and environs and to provide the amenities described, however when rendering our services, the information that we disclose is based on the facts at the time of our visit to the accommodation or on the information provided to us by the accommodation providers. We cannot therefore be held responsible for any changes that become known after the web brochure pages are published nor can the company accept liabilities for happenings outside its reasonable control, such as breakdown of domestic appliances, plumbing, wiring, water and electricity cut-offs by the public bodies for maintenance, etc., delays of travel services etc., weather conditions, invasion of pests, owners negligence resulting in loss, injury or accident.
The company undertake to advise you of any material changes known to them prior to your departure. We cannot accept responsibility for any information not contained in this web brochure being confirmed verbally by the accommodation providers unless they subsequently reconfirm this in writing by e-mail.
Accommodations marked with
have been visited by us and we have made every reasonable effort to describe the property as it was at the time of our visit.
In the case of the descriptions been provided by the accommodation providers we have no reason to believe, that at the time of publishing the documents in the web brochure were not accurate but true to fact, as we trust in our accommodation providers honesty. If an accommodation is equipped with air-conditioning, the period and time of functioning of the system is at the accommodation providers’ discretion. All distances stated are approximate. Excursions and trips are subject to demand at any given time. The use of sports facilities such as tennis courts, swimming pools and others described in the accommodation details are at managers' absolute discretion and may be closed due to maintenance, etc., The Company accepts no liability for this whatsoever.
